DEPOSIT & REFUND POLICY

*Many of our tours fill up well before the season starts so we require a deposit to confirm your reservation which is non refundable after August.

We will refund half the deposit if you cancel before August.

*No Refund in case of cancellation after August

but we can apply your deposit to the following season’s reservation in certain cases of emergencies.

The balance is paid in pesos upon arrival to Guerrero Negro

*We can sometimes adjust dates if & when scheduling permits.

*In the case of cancellation due to weather (very rare), the tour will be rescheduled or a rain check given.

**WHALE MAGIC TOURS RESERVES THE RIGHT TO DENY SERVICE TO ANY CLIENT WHO IS INTOXICATED, AGGRESSIVE OR DISPLAYS UNACCEPTABLE BEHAVIOR.

IT IS IMPORTANT THAT YOU READ THIS NOTICE IN ITS ENTIRETY

 We take every precaution to ensure all your travel arrangements are accurate. To serve you better it is IMPERATIVE you read this itinerary carefully to ensure it corresponds to your requirements. Check all your documents upon receipt and advise us of any changes immediately.

 We act solely as agent for the supplier(s) whose service(s) are being arranged for you. We will provide you with printed material, when such material is available to us and explain those portions that relate to the services offered, prices and terms and conditions.

These suppliers are independent parties over which we exercise no direct control. We cannot be responsible for their act or omissions. Nor do we assume responsibility for any claims, losses, damages, costs, expenses, delays or loss of enjoyment to you or your traveling companions or group members, resulting from: The acts or omissions of anyone other than us or our employees, acting properly on our behalf. No employee, agent or representative of ours has the authority to modify, waive or alter any provisions of the Notice.

Unless the term “guaranteed” is stated in writing on your tickets, invoice or itinerary we do not guarantee any of the supplier(s) rates, bookings or reservations; we are not responsible for any injuries, damages or losses caused to you in connection with terrorist activities, social or labor unrest, mechanical or construction difficulties, diseases, local laws, climatic conditions, abnormal conditions or developments or any other actions, omissions or conditions outside our control.

There may be different standards and practices and different standards and conditions with respect to the provision of utilities, services and accommodation. Information on “relevant laws and customs and documentation” is obtainable through tourist offices, consulates, etc… of the applicable destination.

Many of the problems for which we cannot be responsible can be insured against. We strongly recommend that you obtain insurance coverage.

Through your payment to us for these travel services, you are acknowledging your acceptance of our terms set forth in this Notice.
